Il faut rappeler que seuls les titulaires d’une convention d’accueil peuvent prétendre au statut de scientifique. Le deuxième alinéa de l’article R.313-11 du CESEDA subordonne l’accès de l’étudiant au statut de scientifique à la présentation d’un contrat de travail ou d’un contrat de droit public d’agent non titulaire de l’État pour des travaux de recherche de même nature que ceux décrits dans la convention d’accueil. Il s’agit en l’occurrence d’un contrat de droit français pour lequel le visa des services de la main-d’oeuvre étrangère n’est pas requis. Il peut s’agir notamment d’un contrat doctoral, créé par le décret n° 2009-464 du 23 avril 2009, d’une convention industrielle de formation par la recherche (CIFRE), ou d’un contrat d’allocataire de recherche, moniteur ou non. »
